Please read these Terms of Use ("Terms") carefully before using the MomentCast mobile application ("App") operated by Mindsall, Inc. ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms.
1. Use of the App
MomentCast allows you to cast photos and videos from your iPhone to an Amazon Fire Stick device over a local Wi-Fi network. You may use the App for personal, non-commercial purposes in accordance with these Terms.
2. Subscriptions and Auto-Renewal
MomentCast offers the following auto-renewable subscription options:
Both plans include a 7-day free trial for new subscribers. After the trial period, your subscription will automatically renew at the applicable price unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged upon confirmation of purchase and upon each renewal.
You can manage and cancel your subscription at any time in your iPhone Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period. You will not receive a refund for the unused portion of a subscription period.
3. Free Trial
If a free trial is offered, you will not be charged during the trial period. The trial automatically converts to a paid subscription unless cancelled at least 24 hours before the trial ends. Any unused portion of a free trial period will be forfeited upon purchase of a subscription.
4. Intellectual Property
The App and its original content, features, and functionality are owned by Mindsall, Inc. and are protected by applicable intellectual property laws. You retain full ownership of all photos and videos you cast through the App.
5. Prohibited Uses
You agree not to use the App to cast content that infringes on third-party copyrights or other intellectual property rights, or to use the App for any unlawful purpose.
6. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. Network performance and device compatibility may affect functionality.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Mindsall, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date above. Your continued use of the App after changes constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
